| Article VIII Notices.
Section 8.01. Notice to Mortgagee.
Any Owner who places a first mortgage lien upon his lot may notify the
Secretary of the association or the Managing Agent and provide the name and
address of the Mortgagee, or Mortgagee may do so, with a statement as to
whether notices are to be sent to the Mortgagee. A record of such Mortgagee
and its name and address shall be maintained by the Secretary or the
Managing Agent and any notice required to be given to the Mortgagee pursuant
to the terms of the Declaration or these By-Laws shall be deemed effectively
given if mailed to such Mortgagee at the address shown in such record at the
time provided, or as to which the Association is later notified in writing.
Unless notification of any such mortgagee and the name and address of
Mortgagee are furnished to the Secretary or the Managing Agent, either by
the Owner or the Mortgagee, no notice to the Mortgagee as may otherwise be
required by the Declaration or these By-Laws shall be required.
Section 8.02 Notice of Owners. Each
Owner shall have the duty to notify the Association of his address for
notice purposes and all notices duly mailed or delivered to that address
shall be proper notice hereunder. The Association shall have no duty to send
notice to any Owner, to any other address or to any Owner for whom the
Association has no address..
